GENERAL CONDITIONS of the CONTRACT of CARRIAGE

 

This ticket is non-transferable, and is delivered subject to the ticket regulations of Delta Argentina Uruguay S.A. or DAU (hereinafter the Company) provided herein. This ticket only includes the river transportation service and does not imply any obligation for the carrier to provide any additional service. In order to board, passengers must be in possession of their corresponding ticket duly authorized by the Company. The ticket is non-transferable and valid only for the date and time indicated therein. The validity of the tickets shall be that indicated on the ticket according to the fare paid, after which the ticket shall have no value. The Company reserves the right to substitute the scheduled vessel, modify schedules, itineraries and/or duration of the trip, when circumstances of force majeure so require. In accordance with the legislation in force, the company disclaims all liability for acts of God, force majeure relating to the vessel, acts of the authorities and/or acts of nature that prevent the completion of the trip on the date and/or vessel and/or schedules and/or classes of service agreed upon.

The service to be rendered does not imply the obligation on the part of the Company to use a particular vessel, and the carrier reserves the right to change the vessel, even if it does not have the same characteristics as the one originally planned to comply with a given frequency. The change of vessel shall in no case generate in favor of the passenger the right to reimbursement or payment of difference for lesser value.

Any passenger who presents himself for embarkation on a voyage other than the one indicated on his ticket shall be accepted if the capacity of the vessel allows it, and shall pay the pertinent surcharge, if applicable. Boarding will be denied to any person whose ticket is unpaid and/or who is in debt for tickets prior to the date of travel. The company reserves the right of admission of the passenger.

MODIFICATIONS

In case of cancellation of the trip, the passenger must cancel his/her reservation by contacting the Company in person or by telephone at least 12 hours before the departure time of the vessel corresponding to the date and time of travel marked on the ticket in order to leave the ticket open or to mark a new date.

REFUNDS

In cases where the fare paid allows the refund of the ticket, the passenger must communicate personally or by telephone the cancellation of the trip at least 24 hours before the departure time of the vessel corresponding to the date and time of travel marked on the ticket in order to process the refund prior to the scheduled date. In such case, the request for refund of the ticket price must be made by the passenger within the validity period of the ticket and shall be subject to a 30% withholding. The ticket holder shall lose the right to a refund of the amount paid when the cancellation is not made within the stipulated period and in the stipulated manner. Tickets belonging to Tourist Packages and/or promotions are non-refundable; in case of not traveling, they will remain open to be used until their expiration date. Tickets purchased in Argentina are refunded in Argentina, tickets purchased in other countries are refunded in the country of purchase.

In case of purchase by non-face-to-face means, and within the conditions of art. 16 of law 17250, you have the right to revoke the acceptance within 5 working days from the date of conclusion of the contract.

Monday to Friday from 9 am to 11 am and from 2 pm to 6 pm.

- Tickets purchased at travel agencies with their own issuance are refunded only at the same agency where the transaction was made.

LUGGAGE

Passengers are entitled to carry free of freight up to 10 kg. and a maximum of two pieces of luggage per entire passage, having to pay the corresponding freight for weight and pieces of luggage exceeding this allowance. Baggage includes only personal effects, understood as clothing and toiletries. In case the passenger carries other goods, the Company shall not be liable for their loss, damage or theft. If the passenger wishes to include effects not included in the above, he/she must declare them to the company when checking in his/her luggage and the company reserves the right to transport them included in the luggage or to require the passenger to carry them with him/her. The Company disclaims its responsibility for compliance with customs regulations, which is in all cases at the sole risk and expense of the passenger. The Company assumes no responsibility for loss or misplacement of luggage unless the corresponding value is declared by the passenger at the time of boarding and verified by the ship's steward.

LIMITATION OF LIABILITY

All limitations of liability contained in the relevant laws and International Treaties ratified by the Republic of Argentina, Brazil and Paraguay are applicable to this contract of carriage.

JURISDICTION

Any claim arising in connection with this Ticket and/or as a consequence of the trip shall be subject to the jurisdiction of the Courts of the City of Posadas Misiones.

APPLICABLE LAW

The laws of the Republic of Argentina are applicable to the contract of carriage and to any claim made under this contract.

BAGGAGE, INJURY AND DEATH

Any claim for baggage, injury or death shall be subject to the Athens Convention of 1974 relating to the Carriage of Passengers and their Baggage by Sea ("Athens Convention"), as incorporated into the domestic law of the Argentine Republic. The Athens Convention provides for limitation of liability in respect of claims for baggage, injury or death.

BOARDING

Boarding formalities begin 30 minutes prior to the ship's departure.
